This article, after identifying the role of the Democratic States in formulating practices to annihilate cultures and mother tongues, deals with the investigation of the Neapolitan experience as a representation of a vulnerable and resistance group.

Throughout the investigation, the authors proposed the recognition to the United Nations, of the Human Right to Cultural and Linguistic Resistance to the international language and culture preservation of any peoples subjected to linguistic and cultural violence.

It is through language that peoples can preserve their identities and resist against dominant states, sometimes democratic, sometimes dictatorial.

The struggle for the preservation of the Neapolitan language, to which the Accademia Napoletana continually contributes, is the contradiction of the violent domination of historically constituted States, as it is the constant and daily representation that these Democratic States are extremely violent and repressive.

Naples is today the representation of all communities that put mirrors on violent states and make them see their own images distorted by the historical atrocities that represent them.

Faced with the case of resistance in Naples embodied in the struggle to maintain the culture and language of a people in a vulnerable condition, the call for the creation of a new category of human rights is urgent (ARENDT, 1994).

Thus, we propose the recognition by the peoples linked to the United Nations of the Human Right of Cultural and Linguistic Resistance, as an instrument of international protection of peoples in conditions of vulnerability against real and symbolic violence.

The proposal for the recognition of the Human Right of Cultural and Linguistic Resistance follows the guidelines of the United Nations in recognizing new Human Rights according to the social realities present in the most diverse conflicts.

And, from the Neapolitan experience, recognizing the existence of a subjective right to Cultural and Linguistic Resistance, it will be possible to preserve the identity of the culture and language of peoples in similar conditions, guaranteeing these universal values ​​to present and future generations, as the expression of safeguarding the intangible heritage of a people.

In view of the various forms of violence resulting from the creation of embarrassments or threats to the preservation of the language and culture of vulnerable peoples, resistance is a right to be conquered by all, which is why the recognition of the Human Right of Cultural and Linguistic Resistance is urgent for the preservation of the essence of peoples at risk of the disappearance of their most elementary values, linked to culture and the mother tongue.

Violence has been present in human history since its beginnings, and it manifests itself in multiple ways, both through state and non-state instruments. In this article, whose object was to analyze the experience of preserving the Neapolitan culture and language in moments of hostility to its intangible heritage.

We use Naples as a case study, as a result of the traditional resistance and Neapolitan speakers to the manifest violence against their cultural values.

Throughout our investigation, depending on the striking Neapolitan resistance, which has manifested itself for millennia, we propose to the United Nations the recognition of the Human Right of Cultural and Linguistic Resistance for the effective preservation of vulnerable peoples, to defend immaterial values ​​linked to the identity of the culture and the mother tongue.

The Human Right of Cultural and Linguistic Resistance is inherent to the human species, since it is a preservation of great relevance to safeguard existential rights of an interrelational nature.

O presente artigo, após a identificação da atuação dos Estados Democráticos na formulação de práticas de aniquilamento da cultura e língua materna, ocupa-se da investigação da experiência napolitana enquanto representação de um grupo vulnerável e de resistência. Ao longo da investigação, os autores propuseram o reconhecimento, por parte das Nações Unidas, do Direito Humano à Resistência Cultural e Linguística para a preservação internacional da língua e da cultura dos povos sujeitos à violência linguística e cultural.
